MOD consultation closing 23 Feb 17 - "Better Combat Compensation"
The Ministry of Defence published proposals in December 2016 for changes to compensation for the serious injury or death of armed forces personnel "in combat". The MOD proposes to remove any right (which was already limited) to pursue the Ministry through the courts for compensation for injury or death "in combat" where there had been negligence. Every case would instead be compensated solely under the existing Armed Forces Compensation Scheme, but the amounts payable for injury or death "in combat" would be raised to the level which would have been awarded by the courts.
Non-combat claims would be unaffected, whether dealt with under the AFCS or, in cases of negligence, through the courts.
The consultation closes at 11.45 pm on Thursday, 23 February 2017.
