Following the oral hearing on 8 October, the MOD has obtained permission from the Inner House of the Court of Session to pursue a further appeal in the Milroy reservist pension case.
This landmark case brought by Major (retired) Charles Milroy concerns the Volunteer Reservist attendance-pay divisor and the absence of occupational-pension access for reserve service before 1 April 2015. The Employment Tribunal found for Maj Milroy in 2023 and the Employment Appeal Tribunal upheld that result in January 2026.
Permission to appeal is not itself a reversal of those decisions; the underlying issues remain unresolved while the MOD's appeal proceeds.
